New Grease Waste Requirements Effective July 1, 2022

Beginning July 1, 2022, a copy of the signed, completed service manifest must be retained on-site by the grease waste originator and the grease waste hauler for one year. The service manifest documents the removal and disposal of grease waste.

Overview

Senate Bill 1110 passed in the 2022 Florida legislative session and published in the Laws of Florida 2022-095 creating section 403.0741, Florida Statutes. The new law requires grease waste haulers to dispose of grease waste, including grease waste from grease interceptors, traps and graywater, at disposal facilities and to document grease waste removal and disposal with service manifests.

Additionally, an inspecting entity will verify contracts with the hauler for the grease waste removal, and periodic inspections will be performed to review contracts service manifests. Local governments are authorized to regulate grease waste removal and disposal. The Florida Department of Environmental Protection will adopt rules.

A hauler who violates section 403.0741, F.S., is subject to penalties as stated in the statute. Local governments are authorized to regulate grease waste removal and disposal. Haulers are responsible for complying with appropriate local ordinances, laws or rules.

DEP will begin rulemaking to implement this section of law.
